Inleiding
Aquarius Verhuur (hierna ‘dienstverlener’) is de verwerkingsverantwoordelijke met betrekking tot de verwerking van persoonsgegevens die worden verzameld via het gebruik van onze diensten, websites en sociale mediakanalen (hierna: ‘website’). Dienstverlener respecteert de privacy van alle gebruikers en verwerkt persoonsgegevens conform de toepasselijke privacywetgeving, waaronder de Algemene Verordening Gegevensbescherming (AVG).
Deze Privacy Policy beschrijft welke persoonsgegevens wij verzamelen, hoe wij deze verwerken en beveiligen, en welke rechten gebruikers hebben.
Welke gegevens worden verwerkt
Persoonsgegevens worden verstrekt door woningzoekenden, verkopers, makelaars, woningontwikkelaars of andere geïnteresseerden (hierna: ‘gebruiker’), bijvoorbeeld bij een contactverzoek, aanmelding voor een nieuwsbrief of wanneer er van soortgelijke functies gebruik wordt gemaakt.

Bijzondere persoonsgegevens (indien strikt noodzakelijk en toegestaan)
Wij verwerken in principe geen bijzondere persoonsgegevens, tenzij u hiervoor expliciet toestemming geeft of dit noodzakelijk is voor onze dienstverlening. Bijzondere persoonsgegevens zijn o.a. gegevens over:
● Ras of etnische afkomst
● Politieke opvattingen
● Religieuze of levensbeschouwelijke overtuigingen
● Gezondheid
● Seksuele leven of geaardheid
● Genetische en biometrische gegevens
● Lidmaatschap van een vakbond
Daarnaast verwerken wij geen gegevens van personen jonger dan 16 jaar zonder toestemming van ouder of voogd.
Doel van de verwerking van de gegevens
Wij verwerken persoonsgegevens uitsluitend voor de volgende doeleinden:
● Uitvoering van overeenkomsten, zoals bemiddeling bij koop/verkoop en huur/verhuur van woningen
● Facturatie en administratieve afhandeling
● Afleveren producten (foto’s, ander materiaal) of diensten
● Levering van diensten, zoals marketing- en leadbeheer via Leadflow en/of Pararius Office
● Klantenservice en communicatie via e-mail of telefoon
● Wettelijke verplichtingen, zoals fiscale regelgeving
Verwerkingsgrond voor de verwerking van gegevens
Wij verwerken persoonsgegevens uitsluitend op basis van:
● Uitvoering van een opdracht of overeenkomst
● Wettelijke verplichting
● Gerechtvaardigd belang (zoals marketing of fraudepreventie)
● Toestemming van de gebruiker (voor bijvoorbeeld nieuwsbrieven)
Verstrekking persoonsgegevens aan derden
Persoonsgegevens worden alleen gedeeld met derden indien dit noodzakelijk is voor onze dienstverlening of wanneer wij hier wettelijk toe verplicht zijn.
Wij maken gebruik van software zoals Leadflow en/of Pararius Office voor leadbeheer, CRM en makelaarsdiensten. Deze partijen verwerken persoonsgegevens namens ons en zijn contractueel verplicht om passende beveiligingsmaatregelen te nemen. Wij sluiten verwerkersovereenkomsten met deze partijen.
Daarnaast kunnen persoonsgegevens worden gedeeld met:
● IT- en hostingproviders.
● Marketing- en analysetools (bijvoorbeeld voor websiteoptimalisatie).
● Fiscale en juridische adviseurs indien nodig.
Wij delen persoonsgegevens alleen met derden binnen de Europese Economische Ruimte (EER) of met partijen buiten de EER die een passend beschermingsniveau bieden, bijvoorbeeld door een adequaatheidsbesluit of door het sluiten van modelcontractbepalingen.
Beveiligingsmaatregelen
Wij nemen passende technische en organisatorische maatregelen om persoonsgegevens te beschermen tegen verlies, misbruik en onbevoegde toegang. Dit omvat onder andere:
● Beperkte toegang tot persoonsgegevens voor geautoriseerd personeel.
● Beveiligde opslag van gegevens.
● Periodieke controles en beveiligingsupdates.
Bij een datalek zullen wij, indien vereist, de betrokkenen en de Autoriteit Persoonsgegevens informeren.
Rechten van gebruikers
Gebruikers hebben de volgende rechten met betrekking tot hun persoonsgegevens:

● Correctie van onjuiste gegevens.
● Verwijdering van gegevens indien er geen wettelijke verplichting is om deze te bewaren.

Bewaartermijn
Wij bewaren persoonsgegevens niet langer dan noodzakelijk voor de doeleinden waarvoor deze zijn verzameld, tenzij een langere bewaartermijn wettelijk verplicht is. De bewaartermijn is afhankelijk van de aard van de gegevens en de toepasselijke wettelijke verplichtingen.
Klantgegevens: 7 jaar (conform fiscale wetgeving)
Contactverzoeken: 1 jaar na afhandeling
Na afloop van de relevante bewaartermijn worden persoonsgegevens veilig verwijderd of geanonimiseerd.
